KEPT WORD LLC — TERMS OF SERVICE

Last updated: October 11, 2026

These Terms of Service (“Terms”) govern access to and use of the services offered by Kept Word LLC, a Washington limited liability company (“Kept Word,” “we,” “us,” or “our”), including the Kept Word Chat assistant, the Complete Bundle, related add-ons, and any associated website, forms, or materials (collectively, the “Services”). By submitting a request, creating an account, or using the Services, the church or organization (“Customer,” “you,” or “your”) agrees to these Terms.

1. Nature of the Services

Kept Word provides custom, done-for-you services to churches. These include configuring a website assistant that answers questions using only the Customer’s sermons (and, optionally, designated public website pages), with links to the relevant moment in the sermon video and speaker attribution. The Complete Bundle adds weekly study guides, captioned sermon clips, and social media posts that we write and produce from the Customer’s sermons. Services are expressive and tailored; we configure each assistant to speak in the Customer’s voice and produce content that communicates the Customer’s teaching.

Services are offered only to churches and other organizations, not to individual consumers. Every engagement is set up personally.

2. Statement of Faith and Right to Decline or Discontinue

Kept Word is a Christian company. We maintain a Statement of Faith that reflects our religious convictions. Because the Services involve custom expressive work—configuring assistants that communicate a church’s teaching and, where applicable, writing and producing study guides, clips, and posts—we provide Services only to organizations whose public teachings and positions align with our Statement of Faith.

We reserve the right, in our sole discretion, to decline any request or to discontinue Services (including during a free trial or after service has begun) if we determine that the organization’s public teachings or positions do not align with our Statement of Faith. Decisions are based on the organization’s public materials and positions, not on the personal characteristics of any individual. The assistant, once deployed on a Customer’s website, remains available to any visitor to that site.

Our Statement of Faith is posted at getkeptword.com/beliefs. These Terms incorporate the Statement of Faith by reference for purposes of service eligibility and continuation.

3. Eligibility and Setup

You represent that you are authorized to bind the church or organization. We may require information about your church, leadership structure, and public teachings as part of setup or ongoing service. Setup fees, if applicable, are as stated on our pricing page or in your order confirmation. The one-time library setup fee is waived on yearly plans. Setup fees for add-ons (such as the multi-language add-on) still apply on yearly plans.

4. Fees, Billing, and Free Trial

Fees are as published on our website or agreed in writing (currently including Kept Word Chat at the stated monthly or yearly rate, Complete Bundle at the stated rate, multi-language add-on, and setup fees). Yearly plans are billed in advance. We may change pricing for new or renewing terms with notice.

Every plan, monthly or yearly, begins with a 30-day free trial using the church’s 25 most recent sermons (plus new sermons added during the trial), subject to these Terms and our right to decline. Nothing is charged during the trial, and if you cancel during the trial you owe nothing. At the end of the trial, paid service begins unless you cancel; the remainder of your sermon library is then added, and any applicable setup fee is billed with your first paid month.

Payment is due according to the plan selected. Late payments may result in suspension. All fees are non-refundable except as expressly stated in these Terms or required by law.

5. Customer Content and Ownership

You retain all ownership of your sermons, website content, and other materials you provide (“Customer Content”). You grant Kept Word a limited, non-exclusive license to use Customer Content solely to provide the Services (including transcription, configuration of the assistant, and creation of study guides, clips, and posts). If you choose to have the assistant answer from your website, you authorize us to access, copy, and index the public website pages you designate, and to re-check them periodically, solely to provide the Services.

We do not claim ownership of Customer Content or of the outputs generated specifically for you from that content. Upon cancellation and completion of any outstanding obligations, we will delete Customer Content from our active systems within 30 days; any backup copies age out within 30 days, as described in our Privacy Policy.

6. Data Handling

We handle data as described in our Privacy Policy (available at getkeptword.com/privacy), which is incorporated into these Terms. Key points include: no cookies and no analytics or tracking, on our website or in the chat assistant; the AI provider operates with zero data retention and does not train on Customer data; visitor questions are not stored unless rated (rated items retained up to 12 months without IP addresses); logs retained for a limited period; sermon audio deleted after transcription; and Customer data deleted within 30 days of cancellation as described above.

7. Acceptable Use and Customer Responsibilities

You are responsible for the accuracy and legality of Customer Content and for ensuring you have all necessary rights to provide it. You will not use the Services to violate applicable law. You are responsible for how the assistant and any produced materials are presented on your website or channels.

8. Termination

Either party may terminate for convenience with notice as specified in your plan or order (or 30 days if not specified). Monthly plans may be cancelled at any time, effective at the end of the current billing month. We may suspend or terminate immediately for non-payment, material breach, or misalignment with our Statement of Faith.

Upon termination: (a) your access ends; (b) we will delete Customer Content from active systems within 30 days as described above; (c) refunds are handled as follows:

  • If Kept Word declines or discontinues Services for any reason other than your non-payment or material breach (including misalignment with our Statement of Faith), we will refund any prepaid fees for the unused portion of your term on a pro-rata basis.
  • If you cancel a yearly plan, fees already paid are not refunded.
  • Setup fees and fees for custom work already performed are non-refundable, except as required by law.

You remain responsible for any fees incurred before termination.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET EVERY EXPECTATION. AI-GENERATED OR AI-ASSISTED OUTPUTS MAY CONTAIN INACCURACIES; YOU ARE RESPONSIBLE FOR REVIEWING THEM.

Nothing in the Services or on our website constitutes legal, tax, financial, or professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEPT WORD’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO KEPT WORD IN THE THREE (3) MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

11. Indemnification

You will indemnify and hold Kept Word harmless from claims arising out of your Customer Content, your use of the Services, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.

12. Changes to Terms

We may update these Terms by posting a revised version and updating the “Last updated” date. Continued use after the effective date constitutes acceptance. Material changes will be communicated as required by law or as we deem appropriate.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Exclusive venue for any dispute shall be the state or federal courts located in Washington, and you consent to personal jurisdiction there.

14. Miscellaneous

These Terms, together with the Privacy Policy, Statement of Faith (as incorporated), and any order confirmation, constitute the entire agreement. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
